Unless there is a law on the books that is enforceable in a court that mandates all President's cabinet members use official emails, the incident relating to Hillary Clinton is in no way 'legal'. From what I have read and heard talking to my Congressman (Republican), there is no such law exists.
If American voters were that educated, intelligent and vote for candidates on issues, performance and honesty, there would be an entirely new Congress every two and four years.

There are two types of voters, those who are intelligent and informed, they vote for leaders who they know are hard workers, top performers, and have gravitas in international stage like Hillary Clinton. The second is unintelligent, uninformed, BSC REGURGITATES commonly called the Right Wing Nut Job Republicans who dislike fact, science, rationality, and averse to multicultural society, sometimes, also known as bigots and they will never vote for any hard working proven leaders with Gravitas.
They've had a couple of opps moment with this. But in time, this will pass and no one will care or remember.
