that happen in the US.  The Washington Post released a series on the "shakedowns" that happen to citizens on a daily basis traveling on our roadways.  Police will routinely stop citizens for minor traffic violations and then look for ways to justify a search of a vehicle by either asking for permission to search or engage in conversation looking for any thread to give them any type of probable cause.   Police have collected over 2 billion from these stops.  
   
 My advise to anyone who is stop by the police for a traffic stop is the following:  
   
 1.  STFU  
 2. Refuse consent to any search or seizure.  It's your right as a US Citizen.  
 3. STFU  
   
 While these asset foreiture laws were intended to catch the drug dealers, money launderers, police routinely use this ability to fund their departments.  We need to stop this insane Drug War and roll back these laws.  As I have mentioned before, Sen. P. Rand has proposed the FAIR Act to combat this abuse.  Support it.

I'm rebelling against liberal philosophy. Fascism is the natural direction in which to turn.

... if you can convince me otherwise, The people of this nation write legislation, that is enforced through domestic policy. I might believe the Constitution was written to protect the individual. Keep in mind corporations are individuals, my friend.

 
Until then, I'm going to exercise my constitutional rights.

If police stop you on the highway and take your money for their own use, that is theft.

        They can legally forfeit your money ONLY if they had probable cause to believe  the money was “contraband” and if they go to court and prove by either a preponderance of the evidence, or beyond a reasonable doubt, that the money was contraband. So they have to trace it to some drug dealer or criminal .

      And they have to give you a receipt and notify you of the date of the forfeiture hearing. Even then you can get it back by proving you are the innocent owner of the property.

       The Fair Act does not stop them from doing this – it just raises the government’s burden of proof to clear and convincing evidence, redirects where the proceeds go, and stops equitable sharing.

     But don’t confuse civil forfeiture with the kind of outright theft documented by the Post. Those officers should go to jail

...with REAL LIFE.  A cop once gave you a traffic ticket and it had the date on which you had to appear in court.  Right?

Asset forfeiture doesn't work like that, you fake lawyer.  People are innocent until proven guilty; property is guilty until proven innocent.  The owner of the property has to take affirmative steps to get his property back.

Why do you think those greedy cop bastards love asset forfeiture?  Because it's difficult to get the property back.  And YES, it is theft.  The money may not be going directly into the cops' pocket (some of it surely does), but they use it to supplement their already bloated budgets to buy more toys that go boom and throw pizza, beer and hooker parties itemized as "morale boosters."

Okay fake lawyer, try applying your book learnin' to an actual case.  A woman was driving from Florida back home to New York with her son and grandson after looking at condos.  She had $11,000. in cash which she was going to use as a deposit.  While driving through Georgia, she was stopped for speeding.

When the state troopers learned she had such a large amount of cash (perfectly legal), they questioned her on the side of the road for a total of six hours. In the end she was sent on her way — without the cash, which the troopers kept.

So instead of spouting black letter law since that's all you ever do, how about dealing with the real world for once.  How does this New York woman get her $11,000. back from Georgia without spending more than $11,000. to do it?  Maybe you could handle the case for her pro boner.  You can get admitted in Georgia "pro hac vice." (Go ahead, I'll wait while you look it up)

Georgia has one of the toughest asset forfeiture laws in the country.  It's so bad the the ACLU and the Tea Party have teamed up to oppose it.  So what's your advice to a real human being?  Has your book learnin' taught you that?

Here's my advice to you:  STFU and go away already.
