I am actually in favor of either regulating the amount of fresh water an operator can pump, charging operator for depleting the aquifers, or requiring operators to use brackish water instead of fresh water.

That said, just WTF are "poisoned fracking ponds"??? I am required to inject all the frack fluid I recover back into the ground the same as I am require to do with all the salt water I produce. There is no above ground disposal of frack fluid.

NOW, let's talk about that bet that you keep trying to duck even having a conversation about. Do you have that little courage of your convictions where it comes to Rick Perry?

And yes, I understand it's despite Obama, not because of him.  I don't know what the environmental consequences are of all this tracking, but i'd ask the tree huggers, since we don't have enough solar, wind and hydro to make up for this, should we prefer more coal and nukes? Or should be just let the place go dark? Or mortgage it to the Arabs?

It will be the new Saudi Arabia in regards to 'water'. All we need do is convince people that water got through a former oil pipeline is safe to drink and irrigate our crops with.

         When the energy  companies first started fracking, they had no idea what they were doing and wasted vast amounts of fresh water pumped out of the aquifers. By most accounts I’ve read, they have reduced per well consumption but the acquifers in these counties are still being depleted much faster than the refill rate. But with as many as 200 operators in the beds there are still operators who use water very inefficiently.

        So that “lower price of gas” does not reflect the true cost of depleting the acquifers.

         Part of the problem is something called the Rule of Capture. Basically it means the landowner with the strongest pump can pump out water from the acquifer that is actually under my land. And while permits are required for most pumping operations, frackers are exempt from the permit requirement. So they pump as much fresh water out of the acquifer as they want.  The frackers could use brackish water but have no incentive to do so since they can pump as much fresh water as they need.

         Texas has no meaningful regulation of the frackers, as far as water use is concerned. Poisoned fracking ponds are the next environmental catastrophe.  In fact, the frackers are primarily regulated by the Railroad Commission, which gives you some idea of how up to date Texas is with this new technology.  Meanwhile Texas is in a horrible drought and once those acquifers are gone, they will not be refilled in our lifetime.

       So it is no a question of would you rather have coal or nukes. Tell that to the vacationing couple in San Antonio
