LOTS AND LOTS AND LOTS of unanswered questions here.  

What was on the tape the boy sent? Was it him and some other under age girl? How far underage? 12? 13?

Many places a minor cant give legal "consent."

Maybe the girl will be charged.

There are times where forcing him to take pics of an erection would be appropriate, especially if kids are involved.

We only have this one sided version of events from the defense attorney.  

Cant we wait for our outrage after we hear from the prosecutor, get both sides, then decide?

So we have 2 minors (male/female) that sex-ted each other.  Now the Prosecutor wants to charge the boy (now 17) with possessing and producing child pornography.  Apparently the girl (15) sent the boy some photos, the boy in turn, sent a video.  The mother found out and and filed a compliant.

"A Manassas City teenager accused of “sexting” a video to his girlfriend is now facing a search warrant in which Manassas City police and Prince William County prosecutors want to take a photo of his erect penis, possibly forcing the teen to become erect by taking him to a hospital and giving him an injection, the teen’s lawyers said. A Prince William County judge allowed the 17-year-old to leave the area without the warrant being served or the pictures being taken — yet."

Questions:

1.  Have we lost all common sense.  It seems to me we have a clear situation where teenagers to dumb things?
2.  Why isn't the girl being charged as well?
3.  Why is it appropriate for police to think they can force a minor to take pictures of his erect penis?
4.  Why should this be considered pornography when it appears to be a consensual act between 2 minors
5.  Where is the prosecutorial discretion?

I'm all for combating child pornography. Hell I wouldn't be opposed to a castration here and there for those that commit it, but this seems to be just normal teenage stupidity, especially when it comes to the digital age.  Kids, and many adults, fail to fathom the ramifications of sending crap like this electronically.

This stuff drives me crazy!!

Just like us adults are expected to do.  

 
This is a fairly basic concept.... if you want to break the, be smart enough not to get caught.

Common sense, and intent. If they did so, this would go no where.

This is just like PCness run amok, only a thousand times worse.

This is hardly a case where the "crime fits the punishment" this is the same mentality that would lock up everyone on this board for "crimes against humanity" or some such drivel for engaging in simple P4P. A 17 year old and a 15 year old engaging in "sexting" is hardly equivalent to "kiddie porn"

I will express my outrage at this system right now TYVM, because it's simply outrageous.

Don't break it, or play above the rules.

 
That is the lesson children need to be taught. This is the perfect opportunity to teach children...

this golden rule.

 

I'm not talking about the issue at hand, just a broad generalization. In the attempt to teach kids some common sense.

What you call "sexting" is only coming from the defense attorney, right? If the vid he sent the girl was the dude having sex with a 10 year old well...whole different matter....see my point here?

If you are saying generally a 15 yr old and a 17 yr old shouldn't be charged with a felony, or any crime for that matter, for sexting, sure I am with you on that

There is a link to the statue that the boy is accused of violating.  It's broadly written and kiddie porn is simply a nude or partially nude picture of a minor. The way I interpreted the article was that the boy sent a video that included his penis. But I may be incorrect with that assumption. But what is clear to me, there was no intent to produce what we would interpret as pronography. It's just two kids sending pictures and video of themselves to each other. This statue, in my opinion, is being grossly misapplied and it's outrageous.  

We let our politicians criminalize far too much behavior and we end up potentially labeling a minor as a sex offender for the rest of his life.  As a nation, we jail far more citizens than any other major country in the world. We have a real problem.

Can you prove he had no intent to posses the image.

 

I think what you FAIL to realize is... There are different rules for CHILDREN & ADULTS.

I want to hear the defense of all this from the prosecutor. My guess is I am not going to like their justification in jamming up this 17 yo

The girl is as guilty of producing, possessing "Kiddie Porn" as the boy. But we live in a sexist society that borders on 'misandry' where "law" is concerned. (Try reporting to the police that your female SO is beating you up or threatening you with severe bodily harm)

Forcing the boy to submit too photographing his erect penis is in itself  "abuse" and Underage pornography.

"Prosecutorial discretion" unfortunately ends in a society based in greed when the possibility of profiteering on a legal case begins.  

 

Our technology has advanced far beyond our abilities in social structure, mores, laws and its safe guards. IMO these smartphones will ultimately prove themselves the beginning of our end
