I am a provider and would like to shoot a video using a song on the background.  My choices are songs from famous singers.

Can I publish my video on my website without getting in to trouble for using those songs?
or shall I register the video and the site where is published (of course I don't want to do)

I will appreciate your help a lot!

you do need to pay for the use of copyrighted materials.

But seriously, do you really think the copyright holders are going to notice?

Go ahead and use it.  The worst that can happen is that you'll get a cease and desist letter.  If that happens just switch to another artist.

(still not a lawyer

All compositions not protected under copyright law are said to be in the public domain.

If music or lyrics are under copyright protection:
you CANNOT reproduce the music or lyrics
you CANNOT distribute the music or lyrics either for free, for no profit, or for profit
you CANNOT perform the music or lyrics in public
you CANNOT play a recording of the music or lyrics in public--even if you own the CD
you CANNOT make a derivative work or arrangement for public use in any form

Rule of Thumb for Public Domain Music and Sound Recordings:

Musical Works published with a valid Copyright Notice of 1922 or Earlier are in the public domain in the United States.

Essentially ALL Sound Recordings are under copyright protection until 2067 in the United States

At least Fisher is smart enough to say he isn't a lawyer. Im not one either but I have dealt with copyright infringement with travel photos I have taken. I would be very wary of his advice.

In simple terms, if you violate my copyright I can go to your ISP and if I follow the proper process, demand that my material be removed. In most cases the ISP will make a copy of your site and take it off line. You can fight back if you can show you created the material. If it is a Beyonce song, well good luck with that. Then you get to fight with your ISP to get the site back up minus the copyrighted material.

If your ISP is outside the US, then it is unlikely they will pay attention to a DMCA take down.

Needless to say I believe that content creators should be protected from people that want to profit from their work.

Will you get caught, who knows. There are those who look for copyright infringements. In particular I doubt many popular artists would be happy to help market a "provider." You might also piss off a client and they may pay you back with a heads up to the artists people. Last of all you lose the right to complain if someone else steals your photos for their site.

You can learn more from the link below.

search for it on google. You usually pay a one-time fee like $50 to download it. Not famous, but you could find something to set the mood.
