Legal Corner

Your analysis is spot on, if all you had to do is ask, "you're not undercover?" . . .confused_smile

there would never BE undercover!  To the contrary, if I were prosecuting one of these cases, I would 1) point out that if you are really on the up and up, you don't need to advise people of that and 2) have an experienced vice cop testify that the only places they see such disclaimers are when someone is doing what they're not supposed to!

Just curious about something...

I read the ads on BP and many have the "disclaimer" stating something along the lines of this...
By contacting me you are not affiliated with law enforcement...    (see attached).

What I am wondering... How does this hold up in court if you were busted or does that disclaimer even mean anything.

Just curious is all or if anyone ever seeked some legal advise on that subject.

Just one of my random thoughts this Monday.

However.....in my view...and from what I understand....this is a useless disclaimer.....and probably would cause more problems than using it would solve !!

legally, but it's good marketing for those who think that such a disclaimer means she can't possibly be LE if she's posting this. Legally it's no different than a "No Trespassing" sign in front of a meth lab. Or, more pertinently, asking a client if he's LE or affiliated with LE.

There's NO WAY it would ever hold up in court, probably only be used against you!

I have heard of LE going so far as getting head before making an arrest, so it's pretty safe to say that NOTHING is going to help you!! This provider about the head story DID get her charges dropped, but still was arrested and detained.

I was told several times by many people NOT to even put that disclaimer up, just because it IS pointless.

Also, asking someone if they're a cop also doesn't work, they can and will lie about that!

In Florida, the LE doing this stuff HAS to have an out of town number. So if shes in Orlando with a Tampa area code, question her about Tampa! That usually throws up red flags because if they don't know the main streets/highways, they're clearly up to something! Also, cops (in Florida) can NOT come down to the car to get you or meet you for drinks. So if you ever feel sketchy, just ask her to come greet you in the hotel lobby, out the back door, or at your car.

Be safe and have fun all!

Meeting in the hotel lobby, for "her" anyway, can be sketchy because LE will meet in lobbies or public places in order to arrest if they can get the provider to acknowledge an exchange of something for the service. No hotel room need be paid etc.

Thank you for the posts. They have been enlightening and greatly appreciated, by the way :--)
