Honestly, hypotheticals are very hard to get right.  I suggest you take the actual papers to a lawyer & find out the information for your case.   I'm assuming you want to fight the case.  Small cases are sometimes less costly to pay & make them go away.  Moderate cases might be worth arguing to get the amount reduced even if it goes against you.  One thing is certain, if you don't respond, you lose.

I did hear some place that plaintiff can be very easy send back out of the court because most of them failed to make deposit to court to cover costs?  If they are out of the states?
 How to formulate it in law language??

You probably didn't hear that advice from a lawyer, because what you heard is incorrect.  In the USA, a plaintiff in a civil case does not need to make a deposit to the court to cover costs.  That is how it is in some other countries, but not the USA.  

There is also no requirement that the plaintiff must live in the same place where they are suing, they don't.  They don't even have to live in the same country.  All they have to do is file their lawsuit in the court that serves the area where the defendant lives, or where the disputed matter took place.  

So what you are asking about won't work.

He said nothing about your "free lawyers" and their knowledge of the law, only that your point was invalid. And for the record, he is right. Except for a small filing fee, court costs are not required to be posted by either residents or non residents of any state, including NY of course.

I would suggest you check with Mooz and Skvirrel, they are most likely your best fit. lol

Most courts have some kind of filing fee; in general, the case is not considered filed until the fee is paid in full. If a plaintiff meets certain qualifications, the court may waive the filing fees. Filing fees vary by state, county, and sometimes locality. You would need to check with the clerk at the court in which you intend to file. Do not call a clerk in a different county or city; the information they give you may not be correct.  

There are other fees that may be required to be deposited in advance (jury fees, for example, if a jury trial is chosen). Generally, these fees are paid later.

If you're using legal aid, you may qualify for fee waivers (legal aid usually has income requirements in order to use their services).  

If you live in one state, and file in another, the defendant may choose - depending on the amount of the suit - to remove the matter to federal court as one of their options

Please find a lawyer who speaks Russian. Because your communications skills in English are so poor it's impossible to understand what you mean.  Perhaps a Russian-speaker can decipher what you need.

So, pray tell, where exactly is that piece of paper with those statutes that you were going to tell me about?   I am still waiting for you to tell me about them, I really want to know how to win a case using the legal maneuver that you explained before.  Don't hold out on me.
