Hi,  
 I am a newbie considering this hobby seriously. Like many of you here, I want to be very careful and don't want to get into any trouble with LE. One advice I hear repeatedly is not to open the mouth in the unlikely event that you are busted. Did anyone hear experience bust first hand or know what happens during/after bust? I would like to know what was experience or what can you expect. I mean do you get time to talk to a lawyer? Do they take you to the police station/prison immediately? Or is it like a speeding ticket where they give you a piece of paper then you have time to talk to a lawyer. Can you say I need a lawyer. Most likely bust will be in the night or weekend when there are no lawyers available to talk at that time. How to handle this? Any idea? Do you need to select a lawyer ahead of time? Is there any lawyer in CT that you guys recommend? Will you be allowed to go home or do they take you to police station? If they take you to station how long they can keep you there? Will you be able to talk to your family members? If it is a weekend, do you have to wait till Monday for lawyer to show-up and post you bond or something. If you need to select a lawyer ahead of time, what to tell him, it would be embarrassing to state that" I am selecting you to defend me just in case I get busted doing so and so..." Please help answer my questions.

In many larger cities there are magistrates who can set bail 24/7, and then you only need to contact a bondsman to get that set up.  They often have their phone numbers posted at the jail.  In other areas, if you get  busted Friday night, you could be held until Monday AM.  It sucks.

In some cases, you can use a credit card.  If you are an AAA member, they will post bond for you, in fact.

As for the lawyer, you do need to avoid telling the police anything except your name and address.  Police try very hard to get you to incriminate yourself by saying things like:  "Things will go much more smoothly for you if you just cooperate.", etc.

Don't believe them.  They are just trying to get you to make their lives easier.  Also don't fall for the old "She already implicated you." routine.  If she did, then why are they hell bent on trying to get you to incriminate yourself?

Just tell them you want to make a call to a lawyer.  Most lawyers have 24/7 lines to get in touch with them.  It's a good idea to have a lawyer on a retainer.  You don't have to tell him why.

But of course, the best advice is to play safely and not ever need to call a lawyer.

f the act is misdemeanor, can they still arrest you and take you to jail? Don't they have to produce first before a magistrate in a court?

yes, you can be brought to jail, although I have heard of people being given a ticket and told to appear in court at a later date.

The magistrate is the one that sets bail, so you have to be in jail first.

most of the time in los angeles you are given a ticket for misdemeanor 647b (solicitation) and have to appear in court about a month later.  it all depends on the arresting agency and your prior criminal record whether they take you to jail or not.  if they do take you to jail and book you they will either release you on OR or you will have to post bail.  you will have plenty of time to retain a lawyer.  a good criminal lawyer will want between 1500-5000 to represent you through pre-trial.  if it goes to trial (they almost never do) usually that would cost more.  

in most courts in los angeles they are offering first time offenders "john school" which costs about 750 and you will have to attend some classes with other offenders and take an hiv test and when you complete all that it will be dismissed from your record.  providers do not have it as good.  depending on what county you are busted in the punishments for first offenders can be anywhere from a few days in jail, community service, fines, 1-2 years probation, hiv testing and hiv education class.  if you are a provider and charged and convicted it will go on your record as a misdemeanor and you will have to complete all the requirements of your sentence and be off probation in order to file the necessary paperwork to have it expunged from your record OR after you are sentenced and on probation for at least six months for an additional fee you can have your attorney petition the court to have you released from probation and expunged from your record.

it carries a possible sentence of up to a year, I doubt that they will dismiss it outright. Better pay be 4000 to do nothing

but the winner is get the most experienced lawyer you can, you can what? find or afford?

for a misdemeanor? what a joke!!! what a bunch of panty wastes they plea margin everything its stay out of trouble for 6 months and its off your record or plea margin to dis orderly conduct and nothing maybe a fine 150 taxes on your hobby. you think you will be doing hard time for that bj you got! just like the terrorist they win when they get in your head and change your behavior.
