Levels of the Offense for Engaging in Prostitution with an Adult:

The base-level offense for engaging in prostitution with an adult prostitute is a misdemeanor. The patron is subject to a minimum fine of $500. The maximum penalty for a misdemeanor offense is 90 days in jail and a $1,000 fine.

A second conviction for solicitation or prostitution within two years becomes a gross misdemeanor offense. The patron is subject to a minimum fine of $1,500. The maximum penalty for a gross misdemeanor offense is 365 days in jail and a $3,000 fine.

A first time offense can also be charged as a gross misdemeanor if it takes place in a public place. A “public place” is broadly defined and includes a private room at a health club and privately rented hotel rooms. Again, a patron convicted of prostitution in a public place is subject to a $1,500 minimum fine.

Prostitution in a school or park zone carries increased penalties for patrons An otherwise misdemeanor offense will be charged as a gross misdemeanor; a gross misdemeanor will be charged as a felony; and a felony offense will have its maximum penalty increased by three years in prison.

Levels of the Offense for Engaging in Prostitution with a Minor:

Solicitation or engaging in prostitution with a minor (under the age of 18) is a felony offense. If the victim is under the age of 13: the maximum penalty is 20 years in prison and a $40,000 fine. If the victim is under the age of 16 but at least 13 years of age: the maximum penalty is ten years in prison and a $20,000 fine. If the victim is under the age of 18 but at least 16 years of age: the maximum fine is five years in prison and a $10,000 fine.

CONSEQUENCES OF A SOLICITATION OR PROSTITUTION CONVICTION

Certification of Conviction to Driving Record: A permanent record of your conviction will be noted on your driving record. For first time offenses the record will be classified as private data—only viewable by law enforcement. Convictions for subsequent offenses will be classified as public data.

Employment: A solicitation or prostitution conviction may result in the loss or suspension of a professional license.  Additionally, a prostitution conviction will obviously make it more difficult to obtain meaningful employment.

Additional consequences for felony offenses:

Forfeiture: If a motor vehicle was used in the commission of a felony-level prostitution offense it may be seized and forfeited

Civil Rights: In Minnesota, a felony conviction results in the loss of certain civil rights.  Convicted felons may not vote or serve on a jury.

When did busted for hobbying change from a misdemeanor to a gross misdemeanor and why?

the difference is "in a public place" they have decided that a private hotel room is a public place.   If you are near a school it can become a felony.

Almost makes me want to quit the hobby.

Certainly, I'll be seeing even MORE well-reviewed ladies.

Not more as in a greater number but more as in safer, more discrete, and so on.
