Use your own wording, for example I would personally say.

"Sir, with all due respect, I understand you have a job to do, however I *RESPECTFULLY* would prefer to speak to an attorney first"

THEN ZIP IT--SAY NOTHING ELSE---ZIP IT!!!!!
(don't go into "I got rights, the constitution this/that).

Trust me, he's had more Schooling than you have on Georgia Law/Constitutional Law (1000's of hours of class room training)-(especially "DUI-Task Force" Cops

What is the purpose for all this? When (If)--you go to court. You've offered ZERO evidence for the cops to use against you (other than blowing into a machine)--that is EXTREMELY easy to fight.

Finally--*BEFORE* you are under arrest--ie. ever see on t.V. when they say, I'm handcuffing you to "Detain you" you're not under arrest (yet another trick they play)--*YOU* think whatever you say is inadmissible--IT IS NOT--because he clearly said 'you are not under arrest"

if he asks, "Is there anything in the Car I should know about"--
*POLITELY* say  "Sir, with all due respect, I understand you have a job to do, however I *RESPECTFULLY* would prefer to speak to an attorney first"

The importance of *POLITE*--is if you do blow High. They can say, Polite to officer, etc.etc. Judges *WANT* to hear that. Cop gets up there says "He/She was belligerent, hard to deal with,etc.
Judges tend to want to repay that favor and make it hard on you.

*BE SAFE EVERYONE!

With this kind of language  (*NOW*---here's the TRIGGER)  I'm curious to your motives of this pointless post.

they're illegal everywhere, but since LE does whatever they want, they are allowed.  It seems a textbook difinition of "illegal search/seizure"...you've done nothing wrong but they just get to peek their head inside everyone's car just to see if anything is amiss.  I'm 100% against drunk driving in any circumstance, but I do resent them checking me out just cause they feel like it.

....LE still does them all the time in MN. The problem was that doing them in the inner cities was considered racial profiling and that is not done anymore, but MN courts have given state troopers and sheriffs wide latitude to do them for DUI enforcement.  They are now "rolling" checkpoints instead of fixed as before.  In fact there was one on I94 just north of the metro last weekend.  State patrol said in a press release that they arrested 15 drivers.  During the holidays they will be doing "saturation" which means a lot more of them.  Be careful.

If I tried that on the cops, I probably would have gotten my ass kicked.
I cooperated, and the cops tried to help me. They are not all assholes.
First off. The little breathalyzer they use on the street is no good in court.
It's the big one that is hard to fight. They are videotaping the whole thing.
I blew .18. That is up there. The cops knew that if they took me to the precinct right away, I was fucked.
They drove around, and wasted time everywhere they could, so I could sober up.
They got me low enough, so my charge was reduced.
Also had to use a public attorney, who got the charge reduced further.
Cooperating in a smart non incriminating way is not alway a bad thing.

FYI for everyone.

.04 Two drinks with no time to digest. = DWAI
.08 Four drinks... = DWI
Figure all normal drinks are .02. It takes one hour to imbibe.
So if you have six drinks in 3 hours. You may blow drunk.
They actually sent me to school to learn how to drink, and drive.

so even if you refuse, you may lose you license.  But by initially refusing, usually you will be taken back to a station/magistrate and charged, but you are usually given another opportunity to take the test and avoid charges, so if you have not drunk too much, its possible that your body may metabolize the alcohol in the period of delay.  best bet is to remember that as a general rule your body metabolizes one beer/drink per hour, and one drink alone usually will not cause a test exceeding the DUI standards - so use that gauge to estimate when its safe to drive again - i.e. if you go to a function and have 4 drinks, don't drive until at least 3 hours have past since the first drink.  If all else fails, just pull into a parking lot and sleep it off.

1. Don't drink and drive!
2. Call a cab
3. Have a designated driver take you home.

Don't complicate things with all of the bullshit stuff with being polite and all of that. If you are  bombed out... how are you going to REMEMBER to be polite?? Most people who are drunk, all have loose lips.

And you know what they say... 'Loose lips sink ships'. I see your ship sinking real fast now.
