I've operated under the assumption my phone has been monitored since the first year I had one.

I saw this feature on the news last night; apparently the CPD is using a device that intercepts messages/data from cell phones.  And they mentioned that it is particularly useful/intended for throwaway phones.  

 
I guess we'll all have to start developing our mental telepathy abilities....... anyone getting my message??

I'm not worried. When me and my ATF text it's just basic stuff. Nothing incriminatng. CPD has other things to worry about than me and my ATF having sex. Besides I think this technology is more to get drug dealers than consenting adults having sex.

and they can intercept everything. Some versions can "fake" being one of the parties to the call! Can you say "entrapment"?

They could conceivably pull your phone number from an ad, drive around your advertised location, and then intercept your communications (and those who communicate with you) to bag everyone involved. A good reason to be careful and discrete about what we say and write.

The good news is that the cops require probable cause and a warrant to use it. Of course, they have been ignoring the constitution and not getting warrants; at this time at least 3 different lawsuits have been entered against PDs across the country on constitutional grounds. It will probably get harder for them to use these legally, but they may still use them illegally to establish leads, and then build a case using "parallel construction".

The best approach is for all of us to move towards something called "end-to-end encryption". Even if intercepted, calls, texts, data are not decipherable. Redphone is an app for Andoid (there is a version for iOS) that encrypts conversations.  The person you are calling must have it as well for the call to be encrypted. TextSecure does the same for text and SMS. Emails can also be encrypted. Would anyone read a detailed primer on free apps that enabled LE-resistant end-to-end encryption for hobby use?

We have to both up our tech and support protection of our constitutional rights to stay safe and prevent Big Brother from climbing into our beds and seizing us by the short hairs. And believe me... he does want us badly - we're all involved in human trafficking, dont'cha know?

You can forget about entrapment and Miranda rights. Courts don't care about that stuff any more. Besides nobody ever goes to trial. They make you cop a plea and ruin your life without the benefit of presenting any evidence.

If we all use discretion and good judgement it shouldn't be an issue. I'm think a rogue provider or a crazy hobbyist is a bigger threat than LE .

I guess there is no protection from unreasonable search and seizure.

Right. Think of the American right to privacy as a footnote to history.
