For the same reason that some providers say that they're a "Playboy" Centerfold...

These ladies aren't looking for the PSE fan... they're looking for the regular guy, and they use those photos because they're of a hot looking lady, professionally shot, and they can download them off of the internet.

As to question 2, pornstars just have better things to do with their time then go after every provider who steals their photos, just as they don't have the time to go after every one of the adult websites that steal vidcaps and photos from other sites to put together a gallery.
