What this means is that the state is not attempting to prove that Zimmerman willfully murdered Trayvon Martin.
Instead they will set out to prove that -- by going after Trayvon with a loaded gun:
-- even after he had been reminded not to by the 911 operator
-- despite the proper protocals for any neighborhood watch program
-- despite zimmerman's own training in law enforcement
Zimmerman recklessly endangered Trayvon's life.
He WILLFULLY CREATED the circumstances where the gun was used.
In the absence of any eyewitness who had a clear view of the start of the fight,
or the firing of the gun.
Florida authorities wisely avoided the pitfalls of attempting to prove that Zimmerman willfully shot Trayvon in a situation where he had other options.
If the Jury believes that Zimmerman's actions willfully created a situation where he might well use his gun...
then he's guilty under the law.

Teen shot and killed in neighborhood altercation

SANFORD, Fla. (WOFL FOX 35) - Investigators with the Sanford Police Department are still trying to figure out exactly what happened during an altercation which resulted in a fatal shooting in the Twin Lakes area. The shooting happened just after 7 p.m. Sunday evening on Twin Trees Lane. A man who witnessed part of the altercation contacted authorities.
"The guy on the bottom, who had a red sweater on, was yelling to me, 'Help! Help!' and I told him to stop, and I was calling 911," said the witness, who asked to be identified only by his first name, John.
John said he locked his patio door, ran upstairs and heard at least one gun shot.
"And then, when I got upstairs and looked down, the guy who was on the top beating up the other guy, was the one laying in the grass, and I believe he was dead at that point."

There is a difference in law between a child and a minor. A minor is someone under the age of consent, which varies from state to state.
A child is someone between infancy and puberty.
The law does not treat all minors as children. Some crimes against minors, like child molest in some states have 14 or similar ages, and the degree is less serious if the victim is under 14. Some states do penalize sex with a 17 year old, but it is far less serious in those states than the same act would be with someone who is 14.

Many states allow minors over 16 to be tried as an adult.
A 17-year old may be a minor, but he is not a child under the law.
To say that the legal system considers a 17 year old to be a child is wrong.

It depends upon when Zimmerman shot Trayvon
and what the witness saw....
The facts state: There was blood from Zman's nose and back of head.
A witness says he saw Tman on top of Zman beating him.
Zman's dad says Tman threatened to kill Zman.
So according to what we know Tman was on top of Zman,
beating him, and Zman shot Tman while Tman was on top.....
well...Maybe thats true...maybe its not....
Now here is a BIG IF: If Tman got off Zman and Zman
got up AND THEN pulled out his gun and shot him, Thats
a different story. That might explain why Tman was
yelling for help, cause they both got up and Zman went
in for the kill.....but we don't know that for sure.
But think about it...if you ron your back, with someone
on top of you swinging and stuff, it's going to be hard
to pull out your gun....right....so maybe the 2nd scenario
is what happened...
In the first scenario, I think Tman was at fault, and
Zman should be cleared according to the law.
If the 2nd scenario is true, Zman is guilty.
Once again, the mugshot of Zman used by the media
is from 6 years ago, and Trayvon is taller than Zman
and probably has longer arms, so will have the
advantage in a fight. He was not a sweet innocent child.
The indictment is flimsy as hell and he questions of this will even get past a judge.
No disrespect, but I have a feeling Dershowitz knows a whole hell of a lot more about this type of thing than you do...
