This is a America, you can sue anyone for anything, the question always is to you have good case?. That said, if you have contracted with and paid an attorney to file a dissolution action, who then refuses to do so, you could very well have a breach of contract as well as a malpractice claim. In some jurisdictions, you can pursue fee arbitration though the local and state bar associations. You can also file a complaint with state bar association, that tends to light a fire under someone's butt. That said, the outcome of all such actions are usually very fact specific so you will want to be sure you are on solid ground before expending your resources.

You can't "force"or sue a lawyer for failing to file a divorce or any lawsuit unless you've paid the lawyer a retainer contingent on his taking the case because the lawyer led you to believe it had merit and he took the retainer on the basis he was going to represent you in pursuing the case.

If the lawyer investigates the case further and learns it is unwise to file for a variety of reasons, he should immediately communicate that information and offer at least a partial refund based on the time he spent investigating the merits of the case.
